1. Definitions

For the purposes of these Terms:

  • “Site” means aussieagedcare.com and all related subdomains.
  • “User,” “you” or “your” means anyone accessing or using the Site.
  • “Listing” means an aged-care facility entry displayed on the Site.
  • “Free Listing” means a standard, no-cost Listing.
  • “Premium Listing” (or “Featured Listing”) means a paid upgrade to enhance visibility of a Listing.

2. Acceptance of Terms

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please leave the Site immediately.

3. Changes to Terms

We may amend these Terms at any time by posting the updated version here. The “Last Updated” date above will reflect changes. Continued use of the Site after any update constitutes acceptance of the revised Terms.

4. Eligibility

You must be at least 18 years old and comply with all applicable Australian laws to use the Site.

5. Account Registration

  • Certain features (e.g., claiming or managing a Listing) require you to register an account.
  • You agree to provide accurate, current information and to keep your login credentials secure.
  • You are responsible for all activity under your account. Notify us immediately of any unauthorized use.

6. Listing Submission & Conduct

  • Accuracy: You must ensure all Listing information is true, accurate, and lawful.
  • Verification & Removal: We reserve the right to verify, edit, refuse, suspend, or remove any Listing at our sole discretion (e.g., for spam, fraud, or inappropriate content).
  • User Conduct: You agree not to use the Site for harassment, defamation, or any activity that disrupts the Site or infringes others’ rights.

7. Premium Listings & Payment Terms

  • Ordering: Premium Listings are purchased via our online checkout.
  • Payment Methods: We accept major credit cards and PayPal.
  • Billing Cycle & Renewal: Your purchase confirmation will specify the term (monthly or annual). Unless cancelled before the end of the term, Premium Listings will automatically renew under the same terms.
  • Cancellation: You may cancel auto-renewal at any time; cancellation takes effect at the end of your current billing period.

8. Refund & Cancellation Policy

  • You may request a full refund within 30 days of your Premium Listing going live by emailing support@aussieagedcare.com with your order number. No refunds will be issued after 30 days.

9. Intellectual Property

  • All Site content (design, text, graphics, logos, images) is owned or licensed by Premium IT Solutions Pty Ltd and protected by copyright and other laws.
  • You may view and print pages for personal, non-commercial use only. Any other use requires our prior written permission.
  • User Submissions: By submitting content (comments, feedback), you grant us a perpetual, royalty-free licence to use, reproduce, and display that content.

10. Disclaimers

  • “As Is”: The Site is provided on an “as is” and “as available” basis without warranties of any kind.
  • Accuracy: We do not guarantee the accuracy, completeness, or reliability of any Listing data. Always verify directly with the facility.
  • No Professional Advice: Content is for informational purposes and not a substitute for medical, legal, or other professional advice.
  • Third-Party Links: We are not responsible for the availability, accuracy, or content of external sites linked from our Site.

11. Limitation of Liability

To the fullest extent permitted by law, neither Premium IT Solutions Pty Ltd nor its affiliates, officers, employees, or agents will be liable for any indirect, incidental, special, or consequential damages arising from your use of (or inability to use) the Site or its content.

12. Indemnification

You agree to indemnify and hold harmless Premium IT Solutions Pty Ltd and its affiliates, officers, and employees from any claims, losses, liabilities, damages, or expenses (including legal fees) arising from your use of the Site, your breach of these Terms, or infringement of any third-party rights.

13. Dispute Resolution & Consumer Rights

  • Nothing in these Terms limits any rights you have under the Australian Consumer Law (ACL).

  • Unresolved disputes may be escalated to relevant external dispute-resolution bodies under the ACL.

14. Termination

We may suspend or terminate your access to the Site at any time, without notice or liability, for any breach of these Terms or conduct we deem harmful.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with any documents they expressly incorporate (e.g., Privacy Policy), constitute the entire agreement between you and Premium IT Solutions Pty Ltd regarding your use of the Site.
